Privacy Policy

1. Controller

The controller for the processing of personal data on this website and in the Spire app is Profitzly LLC, 1242 Southwest Pine Island Road, Ste 42-348, 33991 Cape Coral, Florida, USA. Privacy contact: hi@git-spire.com.

2. Principle and data minimisation

We process personal data only as far as needed to operate Spire, license it and provide support. Spire is a native macOS app and works locally on your device. We do not process your repositories, files or source code; they do not leave your device through Spire. Its core features do not require an account.

3. Data we process

  • Account and license data: email address, name (optional), license key and the devices on which a license is activated.
  • Download events: when you click a download link we store an event with a coarse source (for example home or pricing) and language, without cookies and without profiling.
  • Support communication: the content and email address of your requests.
  • Server logs: technically necessary log data (for example IP address, time, requested resource) to secure operations and diagnose errors.

4. Purposes and legal bases

We process data to perform the contract and provide the license (Art. 6(1)(b) GDPR), to protect our legitimate interest in a secure, working and abuse-free service (Art. 6(1)(f) GDPR), on the basis of your consent for optional purposes such as the newsletter (Art. 6(1)(a) GDPR) and to meet legal obligations (Art. 6(1)(c) GDPR).

5. Purchase, payment data and our sales and payment partner

Purchase and payment are handled by our sales and payment partner Lemon Squeezy, legal entity Sold Through Link, LLC (formerly Lemon Squeezy LLC), Salt Lake City, Utah, USA. Once you start checkout, your payment and order data is collected and processed directly by this partner. For that data it is an independent controller under the GDPR, not our processor, and it concludes the purchase contract with you. Full card details are processed there only and are not passed to us in clear text; we receive name, email address, country, order and license data. The partner's own privacy policy applies in addition and is linked to you at checkout.

6. Services and processors

For hosting, database, authentication and transactional email we use Supabase. For sales and payment we use Lemon Squeezy (see section 5). For automatic updates of the app we use the Sparkle framework. Data processing agreements are in place with providers that process on our behalf. We will name the full set of recipients on request as part of an access request.

7. Processing in the Spire app

The app checks for a new version at regular intervals via Sparkle; for technical reasons your IP address is transmitted to the update server in the process. When a license is activated and validated, the license key and a device identifier are transmitted to our server. No further telemetry or usage tracking takes place.

8. Cookies and access to your device

The marketing pages set no tracking cookies. In the signed-in area (Studio) we use strictly necessary cookies for authentication only; these are exempt from consent under section 25(2) of the German Telecommunications Digital Services Data Protection Act. Should we use non-essential cookies or analytics in the future, we will do so only with your prior consent (section 25(1) TDDDG, Art. 6(1)(a) GDPR).

9. Transfer to the USA

As we are based in the USA and part of the processing takes place there, personal data may be transferred to the USA. Where a recipient is not covered by the EU-US Data Privacy Framework, we base the transfer on the European Commission's Standard Contractual Clauses and additional safeguards.

10. Retention

We keep data only as long as needed for the stated purposes or statutory retention periods, then delete it.

11. Your rights

You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21 GDPR). You may withdraw a given consent at any time with effect for the future (Art. 7(3) GDPR). You also have the right to lodge a complaint with a supervisory authority (Art. 77 GDPR).
